1. Acceptance of Terms

By accessing and using Ainika's services, including but not limited to our website, products, and manufacturing services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms").

These Terms constitute a legally binding agreement between you ("Customer," "Client," or "You") and Ainika Silicone Manufacturing Co., Ltd. ("Ainika," "Company," "We," or "Us"), a company established in 2000 and operating from Weifang, Shandong Province, China.

Important Notice

If you do not agree with any part of these Terms, please discontinue use of our services immediately. Continued use constitutes acceptance of all terms and conditions outlined herein.

2. Our Services

Manufacturing Capabilities

Ainika specializes in comprehensive silicone product manufacturing with the following capabilities:

  • Design Services: Our team of 11 dedicated designers provides product design consultation and technical specifications
  • Manufacturing: Full-scale production using our 6,600㎡ facility including CNC workshops, vulcanization workshops, and sample production areas
  • Product Range: Over 4,000 designs including molds for chocolates, cakes, ice cream, candles, soaps, and custom applications
  • Quality Standards: All products manufactured using food-grade silicone meeting FDA, CE, and LFGB standards
  • Additional Services: Short-term warehousing and procurement integration services

Service Availability

Our services are available globally. However, specific product availability, shipping options, and compliance standards may vary by region. We reserve the right to refuse service in jurisdictions where our operations may conflict with local laws or regulations.

3. Orders and Payments

Order Process

All orders are subject to acceptance by Ainika. We reserve the right to refuse or cancel any order at our discretion, particularly in cases involving:

  • Insufficient production capacity
  • Technical feasibility concerns
  • Compliance or safety issues
  • Payment verification problems

Custom Orders

Custom manufacturing orders require detailed specifications and may involve:

  • Design consultation and approval phases
  • Sample production and testing
  • Minimum order quantities
  • Extended lead times
  • Non-refundable design and setup fees

Payment Terms

Payment terms are established on a per-order basis and may include:

  • Advance payments for custom orders
  • Progress payments for large orders
  • Net payment terms for established customers
  • Currency and payment method specifications

4. Quality Assurance

Our Quality Control Process

Ainika implements a comprehensive 4-stage quality control system:

  1. Post-Production Inspection: Checking for visible damage, contamination, or defects
  2. Refinement Quality Check: Detailed inspection during product finishing
  3. Pre-Packaging Inspection: Final quality verification before packaging
  4. Pre-Shipment Sampling: Random sampling and testing before dispatch

Material Standards

All products are manufactured using food-grade silicone materials that meet or exceed international safety standards including FDA (United States), CE (European Union), and LFGB (Germany) certifications.

Warranty and Returns

We warrant our products against manufacturing defects under normal use conditions. Warranty claims must be submitted within 30 days of delivery with appropriate documentation and evidence.

5. Intellectual Property Rights

Ainika's Intellectual Property

All designs, trademarks, logos, product specifications, and proprietary manufacturing processes remain the exclusive property of Ainika. Customers may not reproduce, distribute, or create derivative works without explicit written permission.

Customer Intellectual Property

Customers retain ownership of their original designs and concepts provided to Ainika for manufacturing purposes. We agree to maintain confidentiality and will not reproduce customer designs for third parties without authorization.

Collaborative Development

For products developed collaboratively, intellectual property rights will be clearly defined in separate agreements prior to commencement of development work.

6. Limitation of Liability

Scope of Liability

Ainika's liability is limited to the replacement or refund of defective products. We are not liable for:

  • Indirect, incidental, or consequential damages
  • Lost profits or business opportunities
  • Damages resulting from misuse of products
  • Third-party claims or actions
  • Force majeure events beyond our control

Maximum Liability

In no event shall Ainika's total liability exceed the value of the specific order giving rise to the claim.

Customer Responsibilities

Customers are responsible for:

  • Proper use of products according to specifications
  • Compliance with local regulations in their jurisdiction
  • Adequate testing before commercial use
  • Timely notification of any issues or concerns

7. Privacy and Data Protection

Ainika is committed to protecting customer privacy and business confidentiality. Our data handling practices are governed by our Privacy Policy, which forms an integral part of these Terms.

We collect and process information necessary for business operations, including order processing, quality control, and customer service. Customer data is not shared with third parties except as required for order fulfillment or legal compliance.

8. Governing Law and Dispute Resolution

These Terms are governed by the laws of the People's Republic of China. Any disputes arising from these Terms or our business relationship shall be resolved through:

  1. Direct Negotiation: Good faith discussions between parties
  2. Mediation: Neutral third-party mediation if negotiation fails
  3. Arbitration: Binding arbitration under Chinese arbitration rules

9. Modifications and Updates

Ainika reserves the right to modify these Terms at any time. Material changes will be communicated to customers through our website or direct notification. Continued use of our services after modification constitutes acceptance of updated Terms.

For significant changes affecting existing orders or contracts, we will provide reasonable notice and opportunity for discussion.
